This is the same court that allowed Judge Emmet Sullivan’s personal prosecution of Gen Flynn to continue indefinitely after the DOJ dropped the charges.
As I’ve said many times, once a case has even the slightest connection to Trump, the law, the facts, the quality of the arguments, and the caliber of the lawyers making them all become totally irrelevant. The outcome is determined solely by which judges are assigned to the case.

Often pounding on the dias to emphasize her point and raising her voice, Millett badgered assistant attorney general for civil division Brett Shumate about the government’s opposition to Boasberg’s witch hunt.
Here, Millett raised unsubstantiated allegations by a so-called DOJ whistleblower who alleged then acting Deputy Attorney General Emil Bove said DOJ might have to say “f you” to the courts in immigration matters—knowing, of course, activist judges would do precisely what they’ve been doing.
Keep in mind—Bove is now Millett’s colleague on the Third Circuit Court of Appeals. She is suggesting Bove could be investigated by Boasberg WHICH IS INSANE. (But also what Boasberg wants as well.)
But not only is she slamming her colleague on baseless accusations, Millett misrepresented his alleged comment.
Even if he said it—the FU was not directly tied to Boasberg’s “oral command” to return planes on March 15.
This is just a taste of what the administration is up against in DC courthouse.
