The legal term for Jack Smith’s behavior would be obstruction of justice. But in South Carolina, we just call it a lie.

He has repeatedly claimed that he sought NDOs because Donald Trump, not the target of the subpoena, would tamper with evidence, obstruct the investigation, or threaten a witness--which he argued in the J6 case, citing Trump's tweet about Mark Milley committing treason. (This was part of the basis of his gag order on the president, approved by Judge Chutkan.)

But that is NOT the context of the requirements under the Stored Communications Act. The requirements pertain to the subject of the subpoena, not anyone in that person's universe.
