Incriminating Text Messages

… judge to order that all text messages on the cell phones of State Park employees be extracted by an independent forensic expert to recover ALL messages about "smoldering embers" these employees saw in Topanga State Park in the days before the Palisades Fire rekindled, including any deleted texts. "The STATE possesses great responsibility and power to protect its citizens and be a good steward of the public park lands entrusted to its care. As citizens, Plaintiffs trust that the STATE, when wielding that power, will play fair and be honest with its counterparts and the judiciary. The STATE has proven unworthy of that trust at every point in this case. It has misrepresented and withheld evidence from both the Plaintiffs and this Court. If has flouted the Court’s discovery orders. It has done so in an obvious attempt to conceal incriminating text messages in violation of Orders 1 and 2. This is now the third time in the past five months that the Plaintiffs have caught the STATE violating the Court’s Orders. The STATE’s violations have caused prejudice to Plaintiffs."
