They are pressing U.S. District Judge Jeannette Vargas, based in Manhattan, to nullify or adjust the order so that Secretary Bessent and his senior team can receive briefings on the payment system and carry out their mandated duties.
The injunction was issued by U.S. District Judge Paul Engelmayer on Saturday, restricting access to only those career employees who have completed requisite training.
This was in response to lawsuits from Democrats concerned about the security risks posed by associates of Elon Musk from the Department of Government Efficiency.
The Justice Department is now pushing for Judge Vargas to lift Judge Engelmayer’s restrictions immediately, or at least delay them until further legal arguments can be presented in court.
